The NCAA doesn't have an antitrust exemption. It was an antitrust case that broke up the CFB television monopoly, and the O'Bannon case had antitrust elements.
If there were tax consequences to a P5 breakaway, it would be because they dramatically altered the model in some way, but that's a very complicated topic.
A note on the continuing FBS/FCS discussion, note that Idaho is the first school to move back to FCS, and New Mexico might not be far behind. They simply don't have an FBS home, and it's prohibitively expensive to be an independent (if not logistically impossible). I still don't think they'll be the last.
The Big XII situation will be interesting, but I think they take no more than two schools. That only opens two spots, and I don't think it's automatic the league losing a team (or two) fills that spot. The SunBelt is the evidence. They decided, now that they only need 10 schools to play a conference title game, there's no reason to feed two extra mouths that are geographically distant. I can see the American Conference, or Conference USA, making the same decision, in which case there is no trickle-down impact.
